Welcome to Megatech Photos ("we", "our", "us"). By accessing or using our website, applications, or related services (collectively, the "Service"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service.

1. Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) to use our Service. By using our Service, you represent and warrant that you meet the age requirements and have the legal capacity to enter into these Terms.

2. Account Registration

To use certain features of our Service, you may be required to create an account. You agree to:

• Provide accurate, complete, and current information during registration.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized use of your account.

You are responsible for all activities that occur under your account.

3. User Content

You retain ownership of any photos, videos, or other content you upload ("User Content"). Because your content is end-to-end encrypted on your device before upload, we do not access, view, or process the contents of your files. By uploading User Content, you grant us a limited, worldwide, non-exclusive, royalty-free license solely to store and transmit your encrypted files for the purpose of providing the Service to you. This license does not extend to viewing, reproducing, modifying, or distributing your content, and we have no technical ability to do so.

You represent and warrant that:

• You have all necessary rights, licenses, and permissions to upload the content.
• The content does not infringe, misappropriate, or violate any third-party rights.
• The content complies with applicable laws, regulations, and our policies.

4. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Upload, post, or transmit content that is illegal, harmful, defamatory, obscene, or otherwise objectionable. Due to end-to-end encryption, we cannot monitor or inspect the contents of privately stored files. However, you remain solely responsible for ensuring that your use of the Service, including any content you store or share, complies with all applicable laws. This prohibition applies in particular to any content you make publicly accessible through link-sharing features, where the content may be viewed by others and reported to us.
• Attempt to gain unauthorized access to our systems, accounts, or networks.
• Interfere with or disrupt the integrity or performance of the Service.
• Use automated scripts, bots, or other tools to access or manipulate the Service.

5. Intellectual Property

All content and materials provided by Megatech Photos, including software, graphics, text, logos, and trademarks, are owned or licensed by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express permission.

6. Third-Party Services

Our Service may integrate with third-party services. We are not responsible for the functionality, privacy practices, or content of third-party services, and your use of such services is subject to the third party's terms.

7. Termination

We may suspend or terminate your account and access to the Service for violations of these Terms, including but not limited to: abuse of the platform infrastructure, non-payment, fraudulent account activity, or distribution of illegal content through public link-sharing features. Because your files are end-to-end encrypted, termination decisions are based on account-level signals, metadata, reports from third parties regarding publicly shared content, or legal requirements, not on inspection of your privately stored files. In the event of termination, we will make reasonable efforts to provide you with a 30-day grace period to export your data, unless immediate suspension is required by law or to prevent ongoing harm to the Service or its users.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Megatech Photos shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim shall not exceed the greater of (a) the amount you have paid for the Service in the twelve (12) months preceding the claim, or (b) $50 CAD. We employ redundant storage infrastructure and regular backups to protect against data loss, but no system is infallible. We strongly recommend that you maintain your own local backups of any files stored on the Service.

10. Indemnification

You agree to indemnify and hold harmless Megatech Photos, its affiliates, officers, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the Service.
• Your User Content or violation of these Terms.
• Your violation of any applicable law or third-party rights.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the competent courts of Ontario, Canada.

12. Changes to Terms

We may update these Terms from time to time. The updated Terms will be posted on this page with an updated effective date. Your continued use of the Service after changes constitutes your acceptance of the new Terms.

13. Illegal Content and Public Link Sharing Policy

Megatech Photos maintains a strict zero-tolerance policy regarding the use of the Service for the distribution, publication, or sharing of illegal content.

While User Content stored privately within an account remains the responsibility of the user, any content made accessible through public link-sharing features must comply with all applicable laws and these Terms.

Reporting Illegal Content

If any individual, organization, or authority becomes aware of content made publicly accessible through Megatech Photos that is believed to be illegal, infringing, or otherwise in violation of these Terms, such content may be reported to:

Reports should include sufficient information to identify the content in question, including the public URL and any relevant supporting details.

Enforcement and Cooperation with Authorities

Upon receiving a valid report or becoming aware of potentially unlawful publicly shared content, Megatech Photos reserves the right to:

• Immediately disable the public link through which the reported content is being shared.
• Suspend or terminate the associated account.
• Preserve account-level records and metadata (such as IP addresses, timestamps, email addresses, and account activity logs) as required by law.
• Cooperate with law enforcement authorities by providing available account-level information and metadata associated with the account in question, as permitted or required by applicable law.

Due to end-to-end encryption, Megatech Photos does not have the ability to access, view, or decrypt the contents of privately stored files. Enforcement actions related to file content are limited to content made accessible through public link-sharing features, where the content has been decrypted by the sharing user for public access. Megatech Photos will use available account-level data and metadata to identify accounts responsible for sharing content that violates applicable laws or these Terms. Because all stored file contents are end-to-end encrypted, we are able to identify account-level information (such as registration details and IP addresses) associated with reported public links, but we are unable to decrypt or provide the underlying contents of privately stored encrypted files.
